These Terms of Service (“Terms”) govern your use of the online appointment scheduling service (“Service”) provided by Gleam Health, Inc. (“Gleam Health,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, do not use the Service.
Gleam Health provides an online scheduling platform that enables existing patients to book appointments with participating healthcare providers (“Providers”). We operate the Service on behalf of the Provider whose scheduling page you are using.
Gleam Health is not a healthcare provider. We do not provide medical advice, diagnosis, or treatment. No physician-patient relationship is created between you and Gleam Health through your use of the Service. All medical decisions, including appointment availability, cancellation policies, and fees, are determined solely by your Provider.
All appointments booked through the Service are subject to availability and confirmation by the Provider. We do not guarantee that any particular appointment time or provider will be available.
You agree to provide accurate and complete information when using the Service, including your name, date of birth, and any other requested information. You are responsible for ensuring that the information you provide is current and correct.
You agree not to: (a) use the Service for any unlawful purpose; (b) impersonate another person or provide false information; (c) interfere with or disrupt the operation of the Service; or (d) attempt to gain unauthorized access to any part of the Service.
By using the Service and providing your contact information, you consent to receive automated appointment-related communications from Gleam Health on behalf of your Provider. These communications may be sent via text message (SMS/MMS), email, or telephone, and may include:
Message and data rates may apply. Message frequency varies based on your appointment activity. You may opt out of text messages at any time by replying STOP to any message. Reply HELP for assistance.
Consent to receive communications is not a condition of booking an appointment. If you do not wish to receive automated communications, you may contact your Provider's office directly to manage your appointments.
Your Provider may enforce cancellation fees, no-show fees, or advance notice requirements for scheduled appointments. These policies are set by your Provider, not by Gleam Health. Applicable fee amounts and notice requirements will be displayed during the booking process prior to confirmation.
By confirming an appointment through the Service, you acknowledge that you have reviewed and agree to the Provider's cancellation and no-show policies as displayed at the time of booking.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant the accuracy or completeness of any information provided through the Service, including provider availability, appointment times, or fee information.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GLEAM HEALTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL GLEAM HEALTH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED ONE HUNDRED DOLLARS ($100). THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF GLEAM HEALTH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Gleam Health is not responsible for any actions, decisions, or policies of Providers, including but not limited to the quality of care, treatment decisions, cancellation fees, or billing practices.
The Service and all associated content, features, and functionality (including but not limited to software, text, graphics, and logos) are owned by Gleam Health and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
